GIORNATA DELL’AVVOCATO MINACCIATO: 24 GENNAIO 2022
L’Unione delle Camere Penali Italiane aderisce, come già nel passato, all’iniziativa internazionale “Day of the Endangered Lawyer”.
Giunta alla dodicesima edizione, la Giornata dell’Avvocato Minacciato viene celebrata in tutto il mondo il 24 gennaio di ogni anno per ricordare l’anniversario della strage avvenuta il 24 gennaio 1977 e ricordata in Spagna con il nome di “Matanza de Atocha”, quando un commando di terroristi entrò in un ufficio di avvocati giuslavoristi situato, per l’appunto a Madrid in Calle de Atocha, ed aprì il fuoco uccidendone cinque e ferendone quattro.
Il focus quest’anno è sulla Colombia.
Anni di conflitti armati interni hanno consumato il Paese, dove quotidianamente si assiste a gravi violazioni dei diritti umani.
Il Paese registra uno dei più alti tassi di omicidi di human rights defenders, in particolare legati alla terra ed all’ambiente, nonché di avvocati: più di 700 colleghi sono stati uccisi negli ultimi 10 anni.
Gli avvocati vengono costantemente ostacolati nello svolgimento della propria funzione difensiva e di promozione dei diritti fondamentali, stigmatizzando il loro lavoro, minacciandoli, evitando e rallentando qualsiasi tipo di inchiesta che indaghi in merito agli attacchi nei loro confronti.
A tal proposito, non esiste un ordine professionale che tuteli e disciplini la professione.
Tutto ciò si pone in aperto contrasto con la funzione difensiva, i diritti umani ed il ruolo fondamentale dell’avvocato.
Ricordiamo infatti che “Il rispetto della funzione professionale dell’avvocato è una condizione essenziale dello Stato di diritto e di una società democratica. (….)” (Codice Deontologico degli Avvocati Europei, art.1.1.)
Inoltre, “Le autorità pubbliche assicurano che gli avvocati a) siano in grado di svolgere tutti i loro doveri professionali senza ostacolo, intimidazione, molestia o indebite interferenza; b) possano viaggiare e consultare liberamente i propri clienti, sia in patria che all'estero; e c) non siano fatti oggetto, né siano minacciati, di essere sottoposti a procedimento oppure a sanzioni economiche o altro per qualsiasi azione intrapresa in conformità con i loro obblighi e principi (Nazioni Unite, Principi Fondamentali relativi al Ruolo dell’Avvocato, principio 16).
In questa giornata di commemorazione, auspichiamo che il nostro appello in favore dei colleghi colombiani non resti un mero richiamo formale, ma che la Colombia si orienti verso una concreta promozione e tutela dei diritti umani, nonché al riconoscimento ed alla protezione dei difensori dei diritti umani, in particolar modo dei nostri colleghi avvocati, che quotidianamente si trovano ad affrontare ostacoli e minacce nell’esercizio della funzione difensiva.

DAY OF THE ENDANGERED LAWYER: JANUARY 24, 2022
The Italian Association of Criminal Lawyers celebrates, as in the past, the international initiative "Day of the Endangered Lawyer".
In its twelfth edition, the Day of the Endangered Lawyer is celebrated around the world on January 24 of each year to commemorate the anniversary of the massacre that occurred on January 24, 1977 and remembered in Spain as the "Matanza de Atocha", when a commando of terrorists entered an office of labor lawyers located in Madrid in Calle de Atocha, and opened fire, killing five and wounding four.
The focus this year is on Colombia.
Years of internal armed conflict have consumed the country, where serious human rights violations are witnessed on a daily basis.
The country has one of the highest rates of murders of human rights defenders, particularly those related to land and environment, as well as lawyers: more than 700 colleagues have been killed in the last 10 years.
Lawyers are constantly hindered in the performance of their defensive function and promotion of fundamental rights, stigmatizing their work, threatening them, avoiding and slowing down any kind of investigation to investigate the attacks against them.
In this regard, there is no professional bar that protects and regulates the profession.
All this is in open contrast with the defensive function, human rights and the fundamental role of the lawyer.
We recall in fact that “Respect for the lawyer’s professional function is an essential condition for the rule of law and democracy in society.” (CCBE Code of Conduct for European Lawyers, Art.1.1.)
Moreover, “Governments shall ensure that lawyers (a) are able to perform all of their professional functions without intimidation, hindrance, harassment or improper interference; (b) are able to travel and to consult with their clients freely both within their own country and abroad; and (c) shall not suffer, or be threatened with, prosecution or administrative, economic or other sanctions for any action taken in accordance with recognized professional duties, standards and ethics.” (United Nations, Basic Principles on the Role of Lawyers).
On this day of commemoration, we hope that our appeal on behalf of Colombian colleagues will not remain a mere formal call, but that Colombia will move towards the concrete promotion and protection of human rights, as well as the recognition and protection of human rights defenders, especially our fellow lawyers, who daily face obstacles and threats in the exercise of the defence function.
